You hit the point. Discrimination in a disguise is a problem. If the above discrimination case exists, it is a open shot case as well as a class case. In lots of cases, you cannot prove it.

In big companies, all managers are trained by HR on discrimination issue. If someone is showing "discrimination", he is absolutely an idiot. But I guess most of the cases are people don't get along with each other and there probably the other reasons.
