Re: Allegations of Copyright Infringement

Rogers has received a notice alleging that activities associated with your IP address are infringing copyright in material(s) owned or exclusively licensed by others, such as downloading a movie, music, or games.

Your privacy is important to us - we haven't told the sender who you are, and wouldn't do that without being compelled by law, like a warrant or court order. We don't track or keep records about what you do online, just what IP address we assigned to you. With that said, given the dynamic way in which IP addresses are assigned to subscribers, it is possible that the illegal activity complained of in the attached notice was committed by someone else. If this is the case, then the allegations made in the notice would not apply to you.

We're required by Canadian copyright law to send along this notice. However, we can't verify its contents nor its sender and we can't alter its contents in any way. As a result, we are passing along to you the full, unaltered, notice from the sender as we are required to do.

You should also know that we can't confirm the merits of any settlement payment that may be requested by the sender. As Innovation, Science and Economic Development Canada (ISED) says, "The Notice and Notice regime does not impose any obligations on a subscriber who receives a notice and it does not require the subscriber to contact the copyright owner or the intermediary. A notice of alleged infringement is separate from any lawsuit for copyright infringement. There is no legal obligation to pay any settlement offered by a copyright owner".

Furthermore, in 2018, as part of Canada’s Intellectual Property strategy, ISED announced that because a “small number of bad actors have leveraged the Notice and Notice regime to send threatening demands to make settlement payments” it plans to “make it explicit that notices that include such demands do not comply with the regime”.
