昨天分好组,今天中午才好不容易轮到我(100名候选人中第44位),入场面试。所有人都在,中年白人女法官,年轻黑人女书记员,中年白人的控方律师和辩护律师,被刑事起诉的年轻黑人,等等。我验证并宣誓后,律师问我一个问题,大意是问我能否不带种族偏见而客观判决,一共4个选择答案:不确定;应该没问题;或者别的什么等等。我信誓旦旦地说应该没问题(I would be able to...)。但是马上我就被excused(淘汰掉)了。。。其实真的希望我能知道为什么!是不是律师觉得我太自信满满,怕有主观先见的倾向? 而且我回答时没好好看着罪犯的眼睛(他长得不难看象奥总的亲戚)?。。。
几百号人来回merry go round,让法官和律师一一挑选,淘汰率为90%。被筛掉(excused)的人再回到"大池子"里,重新等待下一个案子的新一轮筛选。。。这个过程真的很耗费,不光耗费司法系统的钱财人力资源,还耗费陪审团候选人的时间金钱,还耗费这些人的雇主的资源。
这么耗费,谁都看得出来,可为啥还继续采用这个陪审jury机制呢? 肯定是做了cost-benefit分析和结果统计。软性的社会的利一定大于硬性的个体的弊。一位同去者总结得好:只有这样随机的筛选,才能最大程度保证无偏见的裁决,才能保持大众对法律系统的信心。更多的可以参见我昨天给出的链接 (陪审制度的pros and cons),这里列出一些优点pros:

* legitimizes the law by providing opportunities for citizens to validate criminal statutes;

LOL. Children here are encouraged to build their mock-up courts to learn democracy in schools. This basic understanding is missing here and it would take years of living in Canada to get it, or probably never for some people.
