Introduction. Welcome to www.rolia.com ("Rolia"). Thanks for stopping by. By accessing Rolia you are agreeing to the following terms, which are designed to make sure that Rolia works for everyone. This policy is effective August 20, 2006.

Using Rolia. You will post in the appropriate category or area and will not do any of the following bad things:

• violate any laws or our Prohibited Content Policy;
• be false or misleading;
• infringe any third-party right;
• distribute or contain spam, chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may harm Rolia or the interests or property of Rolia users;
• impose an unreasonable load on our infrastructure or interfere with the proper working of the Rolia;
• copy, modify, or distribute any other person's content;
• harvest or otherwise collect information about others, including email addresses, without their consent;
• bypass measures used to prevent or restrict access to Rolia.

Abusing Rolia. We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Rolia if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Rolia or not, we do not accept any liability for monitoring Rolia or for unauthorized or unlawful content on Rolia or use of Rolia by users.

Content contains stuff from us, you, and other users. You agree not to copy, modify, or distribute Rolia, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights in order to host and display your content.) If you believe that your rights have been violated, please notify us through our Contact Us web page and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party's rights.

Liability. You agree not to hold us responsible for things other users post or do. As most of the stuff on Rolia comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Rolia, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.

Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.

Personal Information. By using Rolia, you agree to the collection, transfer, storage and use of your personal information by Rolia (the "data controller") on servers located in the United States or Canada. You also agree to receive communications from us.

General. These terms and the other policies posted on Rolia constitute the entire agreement between Rolia and you, superseding any prior agreements. This agreement is governed by the laws of Canada. If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below. Except for notices relating to illegal or infringing content, your notices to us must be sent by our online contact form. We may update this agreement at any time, with updates taking effect when you next post or after 30 days, whichever is sooner. We specifically prohibit the following items:

• Tobacco Products
• Alcoholic Beverages
• Baby Walkers
• Blood, Bodily Fluids and Body Parts
• Burglary Tools
• Counterfeit currency, stamps or coins
• Counterfeit Products
• Electronic Surveillance Equipment
• Embargoed Goods
• Escort services that offer or indicate sexual services
• Government and Transit Uniforms, IDs and Licenses
• Illegal Drugs & Drug Paraphernalia
• Illegal Services
• Hazardous Materials
• Fireworks, Destructive Devices and Explosives
• Identity Documents, Personal Financial Records & Personal Information (in any form, including mailing lists)
• Items which encourage or facilitate illegal activity
• Lottery Tickets, Sweepstakes Entries and Slot Machines
• Obscene Material and Child Pornography
• Offensive Material
• Pesticides
• Pictures or images that contain nudity
• Police Badges and Uniforms
• Prescription Drugs and Devices
• Prostitution or ads that offer sex, sexual favours or sexual actions in exchange for money
• Recalled items
• Stocks and Other Securities
• Stolen Property
• Used Cosmetics
• Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, switchblade knives, and martial arts weapons)

The following types of job ads are prohibited on the site

• Multi-level marketing or pyramid schemes
• Business or job opportunities that require upfront or periodic payments
• Business or job opportunities that pay only commissions, unless the ad makes it clear that the sole source of compensation would be commission and clearly describes the product or service that would be sold
• Business or job opportunities that require recruitment of other members, distributors or agents
• Ads that are not clear regarding what type of work would be required

The following types of Personal or Erotic, Service ads are prohibited on the site

• Ads that contain pornographic or individuals engaging in sexual activities
• Ads that ask for sex from under age persons
• Ads that offer sex or sexual activities in exchange for money, products or services
• Ads that depicts a person(s), regardless of gender, engaged in actual sexual conduct
• Ads that contain bestiality
• Ads that contain masturbation
• Ads that contain sadistic or masochistic abuse
• Ads posted by Men in the "Women seeking Women" category
• Ads posted by Men in the "Women seeking Men" category
• Ads posted by Women in the "Men seeking Men" category
• Ads posted by Women in the "Men seeking Women" category

The following types of items are generally permitted to be listed if and to the extent that their sale and purchase is legally permitted in your Province of residence, and that such sales and purchases occur in compliance with applicable laws and regulations:

• Electronic Equipment
• Event Tickets
• Food Items
• Non-prescription Medical Devices
• Real Estate and Rental Properties
• Used Clothing and Bedding
• Vehicles, Vehicle Equipment and Devices

Posting Limit Policy:

You can post certain number of ads in a category of a geographical area.

If your ad is for more than one geographical areas, you may post the ads in each areas. However, within one geographical area, duplicate ads or ads that are too similar to an existing ad that you have posted are not allowed. If you violate this policy you may receive a blocked message during the posting process or may be notified that your ad has been removed from the site at later time. To avoid this, please list whatever you are advertising only once. If you want to relist an item that you are already advertising on the site, please use the "modify" feature to do so. Your message will be pushed to the top of list.

Within a geographical area, duplicate ads or ads that are too similar to an existing ad that you have posted are not allowed. Also, you are not permitted to defame anyone or include "hate speech" directed at individuals or groups in your postings

Finally, any ads that do not make it clear what specific item is offered, ie. posts that refer the viewer to a web site to see products available are prohibited; note that sellers can provide a link to a web site to provide more information about the specific item being advertised. Further, posting a listing on Rolia that solely contains a link to another web site is not permitted.
