跟房东打官司

本文发表在 rolia.net 枫下论坛今天,房东给出了NOTICE OF TERMINATION。
他陈述的理由如下:
this is not a rent increase, but a method to shift responsibility of
the cost of utilities to the ones responsible for the use of those utilities, and thus conserve energy and eliminate waste.

I have rented flats for the past 17 years and have never had to
seperate the cost of utilies from the rent in order to make a resonable profit. this is the first time I have encounted tenants
who are willfully unco-operative by leaving windows open when the heating systenm is on. someone is even intentinally turning
the thermostat up to 30C and simutaneously opening the windows thus forcing the furnance to run continuously, and if this continues, will ultimately break it down. Lights and exhaust
fans have been left on day and night, thus both gas and hydro bills have escalated in multiple proportions. this will force me into bankruptcy if such tenants who will fully sabotage my right to a reasonable rental income are not evicted.

i feel uncomfortable renting to people who intentinally take advantage of my naivety in not seperating the cost of utilities from the rent. the cost of utilities must be borne by the users of these utilities.

现在房东已经把案子送上法庭,我得到听讯(HEARING)通知。
房东是香港人,平时跟他商量点事情,他态度极为不友好,
老是说“根据加拿大法律。。。。。。。”

我现在打算如此反驳:
1,房东在他的理由中多次说我们故意干了他所陈述的那些事,
事实上我们没有故意干那些事,他应该提出证据说我们是故意的。

2, 房东多次说他收的是合理的房租,我可以证明他是收他最大能收到的房租,甚至违反的安省租户保护条例。我是老住户,以前的房租是340,现在涨到490。

3,在收到租约终止通知之前,房东口头跟我们抱怨水,电,气
费都很高,要求我们自己负担,在我们拒绝后, 他立刻拿出租约终止通知,但是半小时不到,他自己提出每个人房租减50元,我们自己付水电气。我们没有当时答应,要求看他1-3月的
账单。过了3天后, 他拿来单子,又改口说每个人减40。

4,当初签租约时,他口头答应他包水电,而且根据上面的他自己的陈述,他是在执行包水电。可是昨天他自己说合同上没写
包水电,就是不包(合同上没写他不包水电)。

5,在平时,我们向他反应公共过道照明灯坏了,我们摔倒,
在冬天,房间温度一般不超过20度,马桶漏水等, 他都以不合作的态度拒绝解决。

我所说的几条都有证人(8个)可以作证。

综上说述,我们认为房东不是象他自己宣称的是个NICE 和NAIVE 的房东,他是一个说话不算数,采取一切不当手段来
损害租户的权益。

根据他的行为,他这次发出租约终止通知, 纯粹是为了获得
他不该获得的收入。

我这样说可以么?希望有经验的人指教。
